Medical costs as business expenses
It is therefore better to have the doctor's services that are not reimbursable by the insurance company run via the company, e.g. via the company's own GmbH.
If the GmbH sends the shareholder-managing director to the doctor for a check-up, the GmbH can deduct this as a business expense.
The managing director does not have to pay tax.
Even the tax authorities see it this way.
According to H 19.3.
Wage Tax Manual, preventive medical check-ups for senior employees do not count as wages.
Case law
The tax authorities base this on a ruling by the Federal Fiscal Court dated September 17, 1982 (BStBl 1983 II p 39).
However, more recent decisions by the tax courts also confirm that employer expenses for health checks do not count as wages.
In 2009, the Düsseldorf Fiscal Court ruled that expenses paid by the employer for examinations for the early detection of cardiovascular or metabolic diseases as well as cancer screening do not count as taxable wages (judgment of 30.9.2009, 15 K 2727/08).
It is important that the examination measures are carried out in the predominant interest of the company.
In the case in question, a specialist chosen by the employer carried out the examinations and provided anonymized evaluations of all the findings.
